Terms and Conditions

1. DEFINITIONS:

Where the context so permits, the following expression shall have the following meanings;

1.1 "The company" shall mean Autofinders (Bakewell) Ltd.

1.2 "The purchaser" shall mean the person in whose name the vehicle is ordered.

1.3 "The manufacturer" shall mean the manufacturer of the respective vehicle.

1.4 "The vehicle" shall mean the motor vehicle or vehicles specified on the Order Form.

1.5 "The order" shall refer to the signed order form.

2. RATIFICATION:

2.1 The order is offered by the purchaser and is subject to acceptance and confirmation in writing by the company.

2.2 The company reserves the right to reject any offer with notice in writing and return the deposit in full.

3. REPUDIATION

3.1 If the purchaser fails to make full payment of the vehicle within 7 days of notification that payment is due, the company is at liberty to treat the contract as repudiated.

3.2 Should the contract be repudiated the deposit shall be forfeited without prejudice to the company's right to recover from the purchaser by way of damages any loss or expense which the company shall incur by reason of the purchasers default.

4. DEPOSIT:

4.1 A deposit of £500 will be paid by the purchaser on submission of the order unless otherwise agreed.

4.2 The deposit in non-refundable as detailed in clause 3.2.

4.3 Any factory fitted options ordered (excluding metallic paint), will be paid by purchaser at time of order.

4.4 Payment of the deposit shall be made by credit, debit card or cheque. Please make cheques payable to Autofinders (Bakewell) Ltd.

5. CHANGES TO PRICES

5.1 Where the company agrees to deliver the vehicle otherwise than to a location chosen at the company's discretion, an additional charge will be made as is detailed on the order.

5.2 Where the purchaser chooses to amend the delivery address after the conclusion of the contract, the charge for delivery may be subject to alteration and this may incur a small administrative fee at the company's discretion.

5.3 The company reserves the right to make changes at any time, without notice, to price dependant only on any changes made by the manufacturer and importer during the model year. The purchaser will be given notice in writing of this change and given the opportunity to void the sale and deposit returned in full if required.

5.4 Prices listed are for information purposes only and do not constitute an offer.

6. PAYMENT OF VEHICLE

6.1 Final payment on collection. The purchaser may collect the vehicle from the company’s premises in Derbyshire on the agreed collection date. Acceptable final payments are either A) a Bankers draft or a building society issued cheque. B) Debit card payment/Switch/Maestro/Visa debit. Cheques are to be made payable to Autofinders (Bakewell) Ltd. C) Bank transfer - The purchaser can make a same day transfer of funds whilst at the companies premises by prior arrangement.

6.2 Final Payment on Delivery (driven delivery included). If the purchaser’s vehicle is to be driven to the purchaser’s home, then the following forms of final payment are acceptable: A) Debit card payment/Switch/Maestro/Visa debit

6.3 Final Payment on Delivery (transported). Unless stated in the vehicle description, delivery to the purchaser is extra. The company can arrange for the vehicle to be transported to the purchasers chosen destination, at a further charge of £1.00 per mile, which is a one way charge. Please note that if you have a part exchange vehicle their will be a £50 charge to collect the vehicle. Final payment is exchanged after the vehicle has been inspected by the purchaser. Acceptable final payments are either A) A Bankers draft or a building society issued cheque. B) Debit card payment/Switch/Maestro/Visa debit. Cheques are to be made payable to Autofinders (Bakewell) Ltd.

6.4 Bank payments: By prior arrangement, the purchaser can pay the final balance to the company by way of a direct bank transfer. Please contact the company’s accounts department for further details.

7. VEHICLE REGISTRATION

7.1 Unless stated otherwise in the vehicle description, all vehicles will be of the current registration at the time of the vehicle being registered.

7.2 Unless stated otherwise in the vehicle description, all vehicles will be Brand new, registered to the customer as 1st owner on the V5C document (log book).

7.3 All vehicles, unless otherwise stated, will have delivery mileage only. Delivery mileage can range from 10 miles to a maximum of 200 miles. This mileage figure is based on when the vehicle leaves the actual supplying dealership where the company has ordered the vehicle.

7.4 In most cases vehicles are driven to the company from the company’s suppliers. If the purchaser does not wish the vehicle to be driven then the purchaser may pay an additional fee to have the vehicle transported to the company.

7.5 In the case that the purchaser has chosen a driven delivery service, this will obviously incur additional mileage to be on the vehicle upon arriving at the purchaser’s delivery location.

8. VEHICLE WARRANTY

8.1 All vehicles are covered by the relevant manufacturers warranty and breakdown cover package. No warranty is given or implied by the company.

8.2 The warranty, breakdown cover and road fund licence on the vehicle will commence on the date of registration. The date of registration may differ from the date in which the vehicle is supplied to the purchaser.

9. CHANGES IN TAX

9.1 All prices quoted include UK VAT at the applicable rate at the time of the order. If after the date of this contract and before delivery to the purchaser there shall be any increase in the amount of tax payable in respect of the vehicle or any of the accessories or the sale thereof, the company shall give notice in writing and the price of the vehicle shall be increased by said VAT amount.

9.2 If after the date of this contract and before delivery to the purchaser there shall be a reduction in the amount of tax payable in respect of the vehicle or any of the accessories or the sale thereof, the company shall reduce the price of the vehicle accordingly.

10. CHANGES TO SPECIFICATION AND SUPPLY

10.1 If for reasons outside of the control of company, they shall be unable to supply a vehicle of the model specified both parties shall be liberated from any further obligations without liability and the deposit of the buyer shall be returned in full.

11. DELIVERY DATE

11.1 The company will endeavour to secure delivery of the goods by the estimated delivery date but does not guarantee the date of delivery and shall not be liable for any claims in respect of delay in delivery.

11.2 The estimated delivery date is not of the essence of this contract.

11.3 The company shall not be obliged to fulfil orders in the sequence that they are placed.

11.4 If the vehicle is not ready for collection within 8 weeks of the approximate delivery date, the purchaser will be offered the opportunity to withdraw from the order and deposit returned in full and both parties will be liberated from any further obligations without liability.

12. TRANSFER OF TITLE/OWNERSHIP

12.1 The vehicle to be sold by the company shall remain the property of the company until payment has been discharged in full.

12.2 Payment shall not be treated as such until cleared funds have been received.

12.3 Once title to the vehicle has been transferred to the purchaser, the company shall be under no further liability.

13. PURCHASERS RIGHTS

13.1 Nothing herein is intended to affect, nor shall affect, the purchaser's statutory rights.

14. GENERAL

14.1 The company shall not be held liable for any delay or failure in performance caused by circumstances beyond its reasonable control.

14.2 Vehicle pictures shown on the website are for illustration display purposes and may not exactly represent the vehicle in which is being enquired.

14.3 This agreement shall be governed by and construed in accordance with the laws of England and Wales.
